Terms of Service

By accessing and using Inducer ("the Service"), operated by Joel Omar Jesusi Quispe (an individual based in Lima, Peru), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these terms, you may not access or use the Service.

These Terms apply to all visitors, users, and any other person who accesses or uses the Service.

Inducer is a subscription-based productivity application for Windows that lets users structure their week into reusable blocks and routines, with the right sound for each activity. Through their subscription, users obtain access to the application's features. The Service may include, among others, the following functionalities:

• Creating activity blocks, each with its own duration and sound.
• Combining blocks into routines and assigning them to the days of the week.
• Access to an instrumental music library with automatic playback when each block starts.
• Offline functionality and usage statistics.
• Subscription and billing management.

Access to Inducer is provided through a paid subscription. Our payment provider, Paddle.com Market Limited and its affiliates ("Paddle"), acts as the Merchant of Record for all orders: Paddle processes the payment, issues the invoice, and appears as "Paddle" on your bank statement. By subscribing you also accept Paddle's applicable buyer terms.

• Price: $9 USD per month, per user.
• Taxes: applicable taxes (VAT, GST or sales tax) are calculated and collected by Paddle based on your country of residence, and are shown before you confirm the payment.
• Free trial: 14 days. No payment method or card details are required to start it, and no charge is made during that period.
• Automatic renewal: when the free trial ends there is no automatic charge; access simply ends. Billing begins only if you subscribe to the paid plan, and from that subscription onwards it renews automatically and $9 USD is charged at the end of each monthly period, unless you cancel before the next billing date.
• Cancellation: you may cancel at any time from the Billing section of your account. You keep access until the end of the period already paid for, and no further charges are made.
• Refunds: governed by our Refund Policy, which includes a 30-day money-back guarantee from the first payment.

We may change the subscription price by giving you at least 30 days notice. The new price will apply only to billing periods following that notice.

To access certain functionalities of the Service, you may need to create an account. You agree to:

• Maintain the confidentiality of your password and access credentials.
• Be fully responsible for all activities that occur under your account.
• Notify us immediately in case of unauthorized use or suspected security breach.
• Provide truthful, complete, and updated information at all times.

Inducer reserves the right to suspend or delete accounts in case of non-compliance.

You agree not to use the Service to:

• Violate any applicable law, rule, or regulation.
• Infringe on intellectual or industrial property rights of third parties.
• Publish, transmit, or disseminate offensive, defamatory, obscene, or illegal content.
• Execute fraudulent, deceptive, or confusing activities.
• Attempt to access, interfere with, or damage systems, networks, or data of the Service or other users.

The Service, along with its original content, functionalities, design, and structure, are and will remain the exclusive property of Inducer or its licensors.

You retain all rights to content you create and publish within the Service. However, by using the Service, you grant Inducer a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display such content as necessary to provide the Service.

The music library and sounds available in Inducer are part of the subscription service and are protected by copyright. Users are granted a limited, personal, and non-transferable license to play this content within the application. Downloading, redistributing, reselling, or using the audio content outside of Inducer is not permitted.

Inducer reserves the right to suspend or cancel your account and access to the Service, at any time and without prior notice, in case a violation of these Terms is detected or for any other justified reason. You may cancel your account at any time from your user settings or by contacting support@inducer.app.

In no event shall Inducer, nor its directors, employees, or affiliates, be liable for indirect, incidental, special, punitive, or consequential damages, including, but not limited to loss of profits, data, use, reputation, or any other intangible loss, resulting from the use or inability to use the Service.

We reserve the right to modify these Terms at any time. In case of substantial changes, we will notify users at least 30 days in advance before the new terms come into effect.

Continued use of the Service after the update implies acceptance of the new Terms.

These Terms shall be governed and interpreted in accordance with the laws of Peru. Any controversy arising from the use of the Service shall be resolved before the competent courts of Lima, Peru.

The Service is provided 'as is' and 'as available', without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet specific expectations. To the extent permitted by applicable law, we assume no responsibility for damages or losses arising from the use of, or inability to use, the Service.
